Accidents Caused By Truck Driver Texting
Due to the sheer size of commercial trucks such as 18-wheelers and tractor-trailers, any collision between a commercial truck and a passenger car is likely to result in serious or even fatal injuries and significant property damage. Commercial truck drivers have the responsibility to ensure their actions protect the safety of other motorists on the highway. When they do not by texting or sending e-mail while driving, they can and should be held accountable for any damage caused.

Some Companies Encourage the Use of Technology While Driving
Many trucking companies equip their vehicles with onboard computers or provide company cell phones to drivers to keep communication open between the truck and home office. Under federal law, these computers must contain a lockout device that prevents the driver from using it while the truck is in motion. Unfortunately, we have proven that some companies deliberately tamper with lockout devices and implicitly encourage drivers to use onboard systems en route to save on time and, ultimately, their own costs.
Whether as a result of personal choices or corporate pressures, distracted driving often causes some of the most severe trucking accidents. The Federal Motor Carrier Safety Administration (FMCSA) has worked to prevent this problem, and under recently passed legislation, the FMCSA "prohibits texting by commercial motor vehicle (CMV) drivers while operating in interstate commerce. [...] Additionally, motor carriers are prohibited from requiring or allowing their drivers to engage in texting while driving."
Our experienced legal team understands how to successfully investigate such cases. We work quickly to subpoena or preserve evidence such as hours logged, cell phone records and other evidence that can easily disappear in the course of investigation. We seek to preserve necessary evidence to pursue maximum compensation on our clients' behalf.
