Freight Truck Accidents

Freight Truck Accident Lawyers

Have you or a loved one suffered serious injury or death in an accident involving a freight delivery truck or 18 wheeler?

For more than fifteen years, freight carriers have dominated the express delivery business in the U.S., and we have all come to rely on them for getting our packages delivered to businesses and personal residences quickly and reliably.

Due to the sheer number of freight carrier trucks on the road in the U.S., these trucks are involved in many motor vehicle accidents each year. In the express delivery business, the accidents are often caused by negligent drivers, many of whom are rushing to meet deadlines and keep up with their demanding schedules. Express delivery drivers may take additional risks and may experience high fatigue levels due to the stress of the job.

Our Truck Accident attorneys are led by Clay Miller who is Board-Certified in Personal Injury Trial Law. Less than 3% of all Texas attorneys have achieved board certification and less than that have a personal injury trial law board certification which required numerous jury trials and the passing a rigorous exam in the specialty.

Our law firm has recovered more than $1.3 Billion in settlements for clients in all kinds of personal injury, wrongful death, car accident cases, truck accidents, construction accidents and even medical malpractice lawsuits.

Causes of Freight Truck Accidents

Human factors that contribute to freight truck accidents:

  • Driver failing to set emergency parking brake before exiting the vehicle, causing roll back into cars, and pedestrians
  • Driver failing to yield when turning or merging
  • Driver backing up after missing delivery address in order to save the time of turning around. This is especially dangerous as often the trucks have blind spots, preventing driver from being able to see rearward when backing, thus preventing a driver from seeing other vehicles, pedestrians, bicycles
  • Driver fatigue, driver intoxication, and driver failure to obey traffic laws
  • Driver inexperience or inadequate training
  • Maintenance crew failing to complete repairs or safety checks

Other factors leading to freight truck accidents:

  • Poor road or weather conditions
  • Poorly secured cargo load
  • Vehicle equipment failure, including brake, tire, or transmission failure

Recent freight truck accidents:

  • 2014: Freer, Texas:
A freight truck accident on US Highway 59 left two dead and four critically injured. The accident involved a van towing a utility trailer, and a freight liner 18 wheeler. The van had pulled over to the side of the freeway when they were rear ended by an 18 wheeler. The freight liner struck the van on the left side and the utility trailer struck the van on the right side causing multiple people to be ejected from the van. Two children were pronounced dead at the scene. Nine adults were transported to different area hospitals.

  • 2014: Orland, California:
A FedEx truck driver crossed a freeway median before slamming into the northbound bus, killing 10 people including several California high school students.
A truck driver for the largest milk hauler in the United States fell asleep at the wheel, causing a wreck that killed my mom, Julia Jones. When the insurance company wouldn't settle, Clay Miller took the case to trial. During cross-examination, Clay made the driver admit he faked his logs and the safety director concede the company was grossly negligent. Just before closing argument, the case settled for $5.8 Million.
